England and Wales flip the switch tomorrow on the new extreme-content rules. Starting November 6, possession or publication of realistic porn that depicts non-fatal strangulation or suffocation, penetrative sex between people a reasonable viewer would think are related (including certain step and foster), or adults role-playing as under-16 becomes a criminal offense. Publication can mean up to five years; possession of the under-16 material up to three and the other categories up to two. FSC’s Alison Boden has called the package draconian and vague. Ofcom guidance is still expected; until then the practical move is talk to UK counsel and scrub libraries. Source

The full Fifth Circuit is rehearing the challenge to Texas’s SCOPE Act. The en banc order vacated the July panel ruling that had blocked parts of the law (including the filtering mandate under Section 230). Age-registration duties were never enjoined.
