Morning Heat — Tuesday, October 6, 2026: California Adult Upload Law

Morning Heat — Tuesday, October 6, 2026

California just put a second recordkeeping regime on adult uploads. Gov. Gavin Newsom signed AB 1705, and it takes effect January 1, 2027. Sites that let users or creators post content and are reachable in California have to collect a verified email plus a statement, under penalty of perjury, that everyone depicted was an adult, consented to being depicted, and consented to the upload. Hold that file for at least seven years. Depicted people can sue for up to $75,000 a violation, plus punitive damages and fees. Prosecutors can seek $25,000 a hit. Each day non-compliant content stays up is its own violation. FSC’s Mike Stabile told AVN reputable platforms already do a version of this, and counsel is already flagging the perjury cert and the reach outside California. If you upload for a living, the paperwork clock starts before New Year’s. Source

Same signature pen, opposite direction on tracking lawsuits. Newsom also signed SB 690, narrowing the California Invasion of Privacy Act so pixel, analytics, and IP-tracking demand letters stop printing money. His note to the Senate called the suits vexatious and aimed at small businesses that installed ordinary marketing software. AVN notes the same wave already hit the parent companies of Pornhub and Bellesa. Adult sites have been soft targets for CIPA complaints because session tools and affiliate pixels are how the traffic actually gets paid. This does not legalize sloppy consent. It cuts the shakedown lane. Talk to counsel before you rip out analytics, but the private right of action just got smaller. Source

Britain is done waiting on the choking ban. The Crime and Policing Bill, passed in April, made pornographic images of strangulation or suffocation a priority offense under the Online Safety Act. Possession can mean up to two years. Publishing can mean up to five. Enforcement was paused for a start date. Ministry of Justice minister Lord Lemos now says the government is bringing the remaining offenses into force this autumn, before December 21, and will announce the date. Ofcom still does not have public criteria for what counts, who investigates, or how a takedown actually runs. UK-facing studios, clip stores, and cam platforms should assume hands-on-neck and breath-play depictions are about to become a criminal file, not a tagging debate. Source

XBIZ is taking the hosted-buyer retreat to Canada. XBIZ Retreat Canada debuts at the W Toronto, August 16–20, four days of one-on-ones and socials for pleasure brands, distributors, and retail buyers. Associate publisher Sara Ramirez called Toronto a real market with an existing community, not a postcard add-on. The city joins Los Angeles and Miami on the retreat map, after Berlin, Amsterdam, and Cabo. The announcement does not print the year on the dates. The copy ran October 5, so the next August on the calendar is 2027. Retail and novelty sellers who missed the U.S. rooms have a Yorkville lobby to book. Contact is retreat@xbiz.com. Source

The pleasure-product floor just closed its own birthday. ANME, the Founders Show, marked 30 years with product spotlights, night events, and the usual buyer-manufacturer scrum, per XBIZ’s October 5 recap. The original room traces to 1996 and names like CalExotics, Nasstoys, and Doc Johnson. AVN had already reported in late August that the expo was ending its run after the Burbank show. Thirty years of novelty buyers in one hall, then the lights. If you sell toys into retail, that pipeline is now XBIZ Expo and the retreat circuit, not a twice-a-year Founders badge. Source

Talent desk is booking, not posting thirst. Alex Legend signed with OC Modeling. Owner Sandra McCarthy called out presence and work ethic and said the job is getting him in front of more directors. Lily Jordan signed with the same agency the same day. Rachel Rampage made her Brazzers debut opposite multi-XMAs winner Mick Blue in “Right Down To Cock Sucking Business.” Agency paper and a Brazzers first scene, not another selfie drop. If you are still unrepped and shooting volume, OC is clearly adding bodies this week. Source

One number: $75,000 — the per-violation civil exposure under California’s new adult upload law, before punitive damages, fees, or the prosecutor’s separate $25,000.

TittyTuesday is the drop today, and we’re already calling the piece a banger. The Hollie Mack profile is up, Phoenix cam vet, studio retired, VIP still live: hollie-mack. Abby Rose is on the homepage if you want the other end of the roster.
