Utah’s 2% adult-content excise tax is in force as of today. SB 73 hangs that levy on “covered” digital sales — streams, subs, clips, games — from sites already treated as age-verification targets. FSC chair Jeffrey Douglas called a tax on speech unconstitutional and still told members to talk to counsel before they skip the check: willful nonpayment can turn into fines and, in the worst case, felony exposure. Privacy lawyers are already pointing at data-hoard risk and the same one-third threshold that has driven major tubes to geoblock instead of comply.
